Tracy Toledo

Tracy (Theressa) was born and raised in Modesto, California. She was drawn to the legal field after working her first summer job in college at a local law firm. Although she had planned a career in medicine, her love of the law quickly took over and she obtained her Juris Doctorate in 1994.

She is an experienced trial attorney and has argued a number of cases before the United States District Courts, the United States Court of Appeals and the California Supreme Court. She is also admitted to practice before the United States Supreme Court and the United States Tax Court. She limits her practice to family law and personal injury.

Professional Background: Tracy has been admitted to practice in various district courts and has argued numerous cases that have been published, as seen below. An attorney’s job is to abide by the law to work in the best interest of whomever they are representing. However, sometimes people can abuse the law to attain these ends. In these instances, Tracy helped work to maintain the integrity of the law and to bring justice to those who were misjudged. Some of these cases are groundbreaking because they recognize the need to make new case laws or even simply clarify current laws.

This personal injury cases’ toxic allegations attempted to blame a company for his injuries. Plaintiff’s vague and insufficient claims were enough to cause the court to dismiss the case and rest with the defendants.

Often, there is a timeline to report personal injury cases. With a certain lawyer, that timeline may be malleable and adjust to the situation. However, even courts can abuse discretion in relieving deadlines. In this case, attorneys fought to show truly what proper diligence means.

In this particular instance, the court worked to fully establish a business proprietors’ obligation to ensure reasonable safety and prohibit criminal activity “that are likely to occur in the absence of such precautionary measures.

This case revised civil jury instructions to formally and more clearly ascertain when the owner of a business is liable for certain injuries occurring in their establishment.
